What are the Legal Requirements for Staff to Child Ratios?

Day Nurseries/preschools must offer an adult to child ratio of;

  • 1:8 minimum for children aged 3 to 5
  • 1:4 for children aged 2 to 3 years old
  • 1:3 for children under 2 years

Childminders may be registered to care for a maximum of 6 children under 8 years old. Only 3 of these may be under 5 years old, with 1 of these being under 1 year. However exceptions can be made for sibling babies these are clarified in Governments Statutory Guide for Foundation Stage (pages: 21/25)

These numbers include any of the childminders own children under the age of eight and are also dependent on the space available with the home.

Childminders can care for older children over the age of eight, however the care must not affect the under eights care.
